Can a Bail Bondsman Enter Your Home?

The Tennessee Code allows bail jumpers to be arrested “at any place in [the] state,” including their residence. This means that bounty hunters can enter your home under certain conditions and may use reasonable force.

Fortunately, there are restrictions to what bounty hunters are allowed to do.

Although bounty hunters have the right to enter your home in certain cases, Tennessee House Bill 1543 also states that bounty hunters are prohibited from entering private property for the purpose of taking a person into custody unless they have the express permission of the private property owner.

Bounty hunters may only enter the property without the property owner’s express permission if a law enforcement officer is present AND there is a search warrant for the private property along with an arrest warrant.

Please also note: There is a difference between a bail bond agent and a bounty hunter. Bail bond agents cannot enter your home. They must hire the services of a licensed bounty hunter.
