Can A Bail Bondsman Harass You?

If a defendant signs a bail bond contract with a bail bonding company, then the defendant has to appear in court at their scheduled times. Otherwise, the bail bond company has the legal right to locate the defendant and bring him or her back to jail with the help of a bounty hunter.

As we mentioned above, if a defendant signs a bail bond contract, then the bail bond company is allowed to locate the defendant with the help of a bounty hunter and bring him or her back to jail if they do not show up for court.

To understand why bail bond companies are allowed to do this, we must first understand what bail is and why it exists.

The Purpose of Bail

Since, in the eyes of the law, everyone is considered innocent until proven guilty, a defendant may be released on bail while the trial against him or her is still ongoing.

The defendant is allowed to enjoy his or her freedom by posting bail, which acts as an assurance to the court that the defendant will show up.

In the event that the defendant misses a court hearing, the court will forfeit the bail, and a warrant of arrest may be issued.

What Bail Bond Companies Are Obligated To do

At this point, if a bail contract has been signed, it is the bail bond company’s responsibility to use all legal means necessary to find the defendant and bring him or her back to jail.

Please note that posting bail gives the defendant temporary freedom so long as he or she follows the court’s requirements. This does not give a defendant free reign, which means a bail bondsman may call you several times to try and get a hold of you, especially if you do not show up for a court hearing.

While the state of Tennessee allows bail bond companies to do everything in their power to get you to make your court appearances and to also work with bounty hunters, they are not allowed to harass you or violate the law in any way.
