How Bail Works 
in Tennessee

Setting the Bail Amount

Bail amount is usually determined by a judge, and in order to get someone out of jail on bail, you must fulfill the bail requirements set by the court.

When you want to bail someone out of jail, you usually have two options.

Be sure to choose the right option for you and your specific situation. Even if you have enough money to pay the full bail amount, it may still be in your best interest to go through a bail bondsman instead.

We have one of our staff members walk every bond into the jail and make sure that it gets where it needs to be to secure a release.

Option One

Cash Bond

The first option would be to provide the full bail amount on behalf of the defendant. This is referred to as a “Cash Bond” and is probably not the best option.

There are two main reasons why this option is less desirable in the Memphis area. First of all, if the defendant fails to attend all court dates, you will not receive your money back. The second thing to consider is that any penalties, fines, and court costs may be deducted from the money you provide for bail.

Option Two

Bail BondsmaN

Your second option is to use a Memphis bail bondsman. This process is usually more appealing because it will require you to provide less money, and no penalties, fines, or court costs will be deducted from the money you provide.

You will pay a fee to the bail bondsman for their services (which is usually set or limited by the state). Note: Tennessee state law states that a TN resident pays 10% plus tax and bond fee ($37.00), out of state residents pay 15% plus ($37.00).

For example, if a judge decided that someone’s bail would be set at $50,000 and a bail bondsman is charging 10%, you would pay $5,000 plus tax of $12.00 and Bond fee of $25.00 to the bail bondsman in order to secure a release from jail.

Out Of State Bail Bonds

These bonds are very similar to regular bail bonds, but they are also more complicated.

The thing is if a person lives out of state, that makes them a potential flight risk in the eyes of many bail bond agencies. Traveling long distances can be a hassle, and naturally, a bail bondsman is unlikely to work with someone if they believe that person will decide to skip out on court.

The good news is there is a solution. Known as a Transfer Bond, this is when two bail bond agencies from different states (one local to the crime and one in the defendant’s home state) join forces to post the defendant’s bond.
