How Long Does It Take To Get Out of Jail After Posting Bail?

You might be wondering, “How long does it take to get out of jail after posting bail?” The length of time varies depending on your jurisdiction and how busy the court is.

How Does Bail Work? Brief Overview

Before you can post bail, you’ll need to attend your bail hearing, during which your bail amount will be set.

Once you know your bail amount, you can either pay the full amount yourself or hire a bail bond company to post bond for you, after which you’ll get out of jail.

There are circumstances in which you can get released from jail without bail. This is called getting released on your Own Recognizance (OR).

After your trial concludes, if you have successfully met all of the court’s requirements, then you’ll receive your bail money back within 60 to 90 days.

In the event you fail to meet all of the court’s requirements, such as not showing up for your court date, your bail money will be forfeit.

Conditions of Bail

Bail conditions vary and include but are not limited to:

  • Completion of rehabilitation programs for drug abuse, mental health, and other addictions.
  • Relinquishing weapons to law enforcement
  • House arrest
  • 24/7 digital monitoring
  • Travel restrictions
  • Checking in with a police officer through phone, email, text, or in person.

Bail Hearing Process

After someone is arrested, they are brought to a police station or jail for booking and processing. Their mugshot is taken, they get fingerprinted, and they potentially undergo a brief medical exam.

They are then held in a cell until their arraignment, during which the prosecutor will decide whether or not to dismiss the charges.

If the charges are not dropped, then the judge will set the defendant’s bail amount and the conditions of their release.

Posting Bail and Getting Out of Jail

It generally takes four to eight hours to get out of jail after paying your full bail amount or posting bond.

With that said, your release can take longer, especially if the court is busy.
