How much is bail for DUI?

August 12, 2022

When answering, “how much is bail for dui? you need to consider some important factors.

(1) The state you are residing in, (2) the number of DUI offenses you have on record, (3) any injuries or deaths caused by the collision, and (4) if there was a minor in the vehicle with you.

How much is bail for DUI in the state of Tennessee?

Bail amounts and penalties for DUI vary from state to state. For information about other states, please see the appropriate resources.
If you’d like to learn more about how bail bonds work, see our article on the subject.

For information about Tennessee bail amounts for DUI, see below:

First-time offense: If you are a first-time DUI offender in Tennessee, you will be looking at fines from $350 to $1500 dollars and potentially jail time.

You may also have to install an in-vehicle breathalyzer called an ignition interlock, which you will be responsible for paying for.

You could also be ordered to attend a rehabilitation program (for which you will be financially responsible) AND potentially be required to cover the medical expenses of the injured party.

Second-time offense: For a second DUI offense, the fine goes up to $3500 and could include jail time of up to 11 months. Additionally, you may have your vehicle taken and your driver’s license revoked.

Third-time offense: For a third DUI offense, you will be looking at a minimum of 120 days in jail. Your fines could also be up to $10,000. Additionally, there is a good chance that your license will be revoked for up to 10 years.

Fourth-time offense: If you are a fourth-time DUI offender, then the offense is no longer a misdemeanor on your record and will be considered a class E felony.

Bail amounts in this case increase substantially. You may also have to pay a fine as high as $15,000 and spend up to a year in jail. As for your license, it may be revoked for eight years.

Severe DUI offenses: If your DUI caused the injury or death of another person, or if a child was in the vehicle with you while you were intoxicated, bail amounts can run even higher, as the offense may be even more serious.

Pre-Trial Program

If you have no prior record during your first DUI offense, you could potentially qualify for a court pre-release program.

This is where you do not have to pay bail if you agree to certain conditions before your trial.

Sometimes in the pretrial program, you will have to wear a tracking device and attend an alcohol awareness course.

There are DUI schools that can help offenders before their alcohol use becomes an extremely serious issue and also aid offenders in regaining their driver’s license.

Cash Bond

You can pay for bail yourself with a cash bond. Or a family member can. All you need to pay cash bail is (1) cash or (2) a credit card.

Bail Bond

If you do not have the funds to pay your full bail amount, you can hire the services of a bail bonds company and only pay a 10 percent bail bond premium.
